What constitutes a violent crime?

Certain felonies that are designated “crimes of violence” carry minimum mandatory prison sentences. The judge cannot sentence you to anything less than the statutory minimum. So if you are convicted, you go to prison. Some crimes that are routinely charged as crimes of violence include:

  • Murder
  • Attempted murder
  • Arson
  • Armed robbery
  • Sexual assault
  • Use of a weapon
  • Rape
  • First and second degree assault
  • Manslaughter
  • First degree burglary
  • Domestic violence

What happens if I am convicted of a violent crime?

When an offense is designated a crime of violence, the normal “presumptive range” of possible prison sentences increases. The consequences of an offense being designated a crime of violence include:

  • The prison term must be at least the midpoint of the presumptive range. If the presumptive range for a certain felony is six to 10 years in prison, for example, the minimum mandatory sentence will be eight years (the midpoint between six and 10) if the offense is designated a crime of violence.
  • The maximum prison sentence is doubled. If the maximum prison sentence for a particular felony is 10 years, for example, the judge can give you up to 20 years if the crime is designated a crime of violence.
  • Use of a dangerous weapon adds jail time. If a weapon is used in the crime, a mandatory five years is added to the sentence.
  • All sentences must be served consecutively. The sentences are not concurrent. They are served back to back. If you have a mandatory 16-year sentence for the original crime and a mandatory five-year sentence for using a weapon in that crime, you will serve 21 years (16 plus five).  Federal crimes could even be more severe.
